Acceptance of the terms

These policies and terms of sale (the “Terms”) apply to any use of the website www.blvdpilates.ca, our booking pages and our MindBody booking platform, as well as to any purchase of services from BLVD Pilates (“we”).

By booking a class or buying a service, you confirm that you have read and accepted these Terms and our Privacy Policy. If you do not accept them, please do not use our platforms or buy our services.

You must be of legal age and have the legal capacity to enter into a contract. A minor may take part in a class only with the written consent of a parent or guardian.

Any significant change to the Terms is indicated by the last-updated date at the top of this page.

Description of services

BLVD Pilates is a Reformer Pilates studio located at 800 Boul. Chomedey, Tower C, Suite 450, in Laval (Quebec). Our offering includes:

  • group Reformer classes;
  • private (Solo) and semi-private (Duo) sessions;
  • class cards, packages and memberships;
  • events, workshops and retreats;
  • corporate programs;
  • instructor training;
  • studio rental to independent instructors.

Events, retreats, corporate programs, instructor training and studio rental may be governed by specific terms communicated at the time of purchase. In case of conflict, those specific terms prevail.

Payment and prices

Transaction security

To book or buy a service, you must create an account and provide accurate, complete and up-to-date information. Payments are processed by secure third-party providers (MindBody, Stripe). These providers apply recognized protection measures, but no system is immune to all unauthorized access. We invite you to read their policies before your purchase.

Prices and taxes

Prices are shown in Canadian dollars. GST and QST are added to the prices shown, unless otherwise indicated. We may change our prices at any time; a change does not apply to a service already paid for.

We may correct any typographical or technical pricing error before the sale is concluded. If the error is discovered after payment, we will offer you either to keep the purchase at the correct price or to cancel it with a full refund.

Payment methods

You can pay in a single payment at purchase or, for memberships, by monthly automatic withdrawal. We accept credit cards online, as well as credit cards, debit cards and cash at the studio.

By choosing a membership or saving a card, you authorize BLVD Pilates to charge that card for recurring payments and for the fees provided for in these Terms. You may revoke this authorization in writing; the revocation does not apply to amounts already owed.

Declined or late payment

A declined or NSF payment incurs a $25 administration fee. Any unpaid amount bears interest at 2% per month (24% per year). We may suspend access to bookings until the balance is paid in full.

Bookings, cancellations and absences

Each class has a limited number of Reformers. A spot that is booked and not used is a spot denied to another client, hence the following rules.

Free cancellation

Group class: At least 12 h before the class

Private session (Solo / Duo): At least 24 h before the session

Late cancellation

Group class: Class deducted + $10 fee

Private session (Solo / Duo): Session charged in full

Unannounced absence (no-show)

Group class: Class deducted + $15 fee

Private session (Solo / Duo): Session charged in full

Arriving more than 5 min late

Group class: Spot may be released; treated as an absence

Private session (Solo / Duo): Session shortened, charged in full

Cancellation

You can cancel a booking in your MindBody account or by writing to us at info@blvdpilates.ca. The time the cancellation is received is authoritative.

Late arrival

For your safety, the warm-up is an integral part of the class. After 5 minutes of delay, the instructor may refuse access to the class and give your spot to someone on the waitlist.

Waitlist

When a spot opens up, the first person on the waitlist is enrolled automatically and notified by email or text. A person enrolled from the waitlist is subject to the same cancellation rules.

Charging of fees

Late cancellation and absence fees are charged automatically to the card associated with your account. We may waive these fees, at our discretion, in the event of a documented emergency.

Cancellation by BLVD Pilates

We may cancel or change a class (instructor absent, insufficient registrations, equipment failure, emergency). The class is then credited back to you, at no charge.

Clients of partner platforms

Clients who book through a partner platform (for example Wellhub) are also subject to that platform’s cancellation and fee policies.

Packages, memberships and gift cards

Class cards and packages

Class cards and packages are personal and valid for the period indicated at the time of purchase. Classes not used by the expiry date are neither refundable nor transferable to a later period.

Introductory offers are reserved for new clients and limited to one purchase per person.

Memberships

A membership has a minimum commitment of 2 months. At the end of that commitment, it continues automatically from month to month, for an indefinite term, without a new fixed-term contract. You may then end it at any time with 30 days’ written notice, as set out in the Termination section.

Since this continuation is not a renewal into a new fixed-term contract, the renewal procedure provided for in section 15.2 of the Regulation respecting the application of the Consumer Protection Act does not apply.

Changing memberships

You can upgrade to a higher membership at any time. A new contract is then concluded and any remaining credit is applied to the new contract. To move to a lower membership, you must terminate the current membership as set out in the Termination section, then subscribe to the new membership.

Suspension

You may ask to suspend your membership for a valid reason (pregnancy, illness, injury, travel or another reason deemed sufficient). The suspension must be requested and approved in writing in advance. It is allowed twice per 12-month period, for one week to one month each time. The membership term is extended accordingly.

Transfer

Class cards may be transferred to another person, once only, on written request to the studio, which makes the transfer between the accounts. You are responsible for finding that person and settling any financial arrangement with them. Memberships and introductory offers are not transferable.

Gift cards

Gift cards have no expiry date and cannot be exchanged for cash. They can be used for any service offered on the booking platform.

Termination and refunds

Termination under the Consumer Protection Act

Statement required by the Consumer Protection Act (contract entered into with a merchant operating a health studio). This text is prescribed by regulation and must be reproduced as is. The French text below is the prescribed wording; an English translation follows.

Translation: “The consumer may cancel this contract without cost or penalty before the merchant has begun to perform their principal obligation by sending the attached form or another written notice to that effect to the merchant. If the merchant has begun to perform their principal obligation, the consumer may cancel this contract within a period equal to 1/10 of the term provided for in this contract by sending the attached form or another written notice to that effect to the merchant. This period starts when the merchant begins to perform their principal obligation. In that case, the merchant may require from the consumer no more than payment of 1/10 of the total price provided for in the contract. The contract is cancelled, without further formality, upon the sending of the form or notice. Within ten (10) days following the cancellation of the contract, the merchant must return to the consumer the money owed to them. The consumer would be well advised to consult sections 197 to 205 of the Consumer Protection Act (chapter P-40.1) and, if necessary, to contact the Office de la protection du consommateur.”

After the 1/10 period

You may terminate your membership or package at any time by written notice sent by email to info@blvdpilates.ca or by registered mail, or by using the cancellation form at the end of this document (download as PDF).

  • Ongoing monthly membership: with at least 30 days’ notice, no termination fee applies.
  • During the minimum commitment or for a prepaid package: BLVD Pilates may require the price of the services already provided and a penalty not exceeding the lesser of the following amounts: $50 or 10% of the price of the services not provided, in accordance with the Consumer Protection Act.

Any amount owed to you is refunded within ten (10) days following termination, using the original payment method.

Termination by BLVD Pilates

We may terminate the contract in the event of non-payment, failure to comply with these Terms or the code of conduct, or any behaviour that endangers the safety of clients or staff. Amounts paid for services not provided are then refunded to you, less the amounts owed.

Health, safety and code of conduct

Your health

BLVD Pilates does not provide medical advice. Before your first class, you must complete MindBody’s health questionnaire and liability waiver and inform us of any injury, medical condition, pregnancy or recent surgery. It is your responsibility to tell the instructor before each class about any change in your condition.

We recommend that you consult a health professional before starting an exercise program, particularly in the case of heart problems, high blood pressure, dizziness, breathing problems, bone or joint problems, or pregnancy. Our instructors offer variations when possible, but a group class cannot be continuously adapted to every particular condition.

Code of conduct

  • Arrive 10 minutes before your first class and 5 minutes before the following classes.
  • Grip socks are mandatory on the Reformer (sold at the studio).
  • Follow the instructor’s directions, especially for adjusting springs and straps.
  • Wipe down your Reformer at the end of the class with the products provided.
  • Phones stay on silent during the class.
  • Any disrespectful, harassing or dangerous behaviour towards clients or staff may lead to termination of the contract.

Equipment

Reformers and accessories must be used only under the supervision of an instructor and according to their directions. You could be held responsible for any damage caused by use contrary to the directions.

Limitation of liability

You acknowledge that practising Pilates, like any physical activity, involves normal and inherent risks, including the risk of injury. To the extent permitted by law, you assume these risks, including those related to your own physical condition or to not following directions. BLVD Pilates nevertheless remains liable for bodily or moral injury caused by its fault or that of its staff.

BLVD Pilates is not responsible for the loss or theft of your personal belongings on its premises, except in the case of gross or intentional fault on its part.

Image, personal information and other provisions

Photos and videos

We sometimes take photos and videos during classes and events for our social media, our website and our advertising. By accepting these Terms, you authorize BLVD Pilates to use, without compensation, images in which you appear for these promotional purposes.

You may refuse at any time: tell the instructor before the class or write to info@blvdpilates.ca. On written request, we will remove from our platforms, within a reasonable time, any publication in which you are identifiable.

Protection of personal information

We collect only the information needed to manage your account, your bookings, your payments and our communications. It is handled in accordance with the Act respecting the protection of personal information in the private sector and our Privacy Policy, and is not disclosed to third parties without your consent, except where the law allows it.

Person in charge of the protection of personal information: mercedes@blvdpilates.ca

Communications and artificial intelligence

We may use automated tools, including artificial intelligence, to send you confirmations, reminders and messages (email, text), follow up on your requests and support certain administrative tasks. You can ask at any time to speak with a person and unsubscribe from promotional communications. The processing of your information in this context is governed by our Privacy Policy.

Governing law

These Terms are governed by the laws of Quebec. Any dispute is submitted to the competent courts of the judicial district of Laval, subject to the rights granted to you by the Consumer Protection Act.

Changes to the Terms

We may change these Terms. For an ongoing contract, any significant change is communicated to you in writing at least thirty (30) days before it takes effect. The notice states the new clause, the previous version, the date it takes effect and your right to refuse the change and to terminate the contract at no cost if it increases your obligations or reduces ours.
